Delhi Chief Minister Arvind Kejriwal arrested for producing him in court on Friday (22nd March 2024). Arvind Kejriwal was arrested for allegations of corruption over the excise policy scam and will be in custody until 28th March 2024.
Bail Denied
The court has denied his bail petition and dozens of Aam Admi party (AAM) leaders were reported as detained by the Enforcement Directorate (ED). Many politicians have responded to the arrest of Arvind Kejriwal where some politicians are against the arrest while others are in favor of the arrest and responded accordingly. Why Arvind Kejriwal Arrested?
The enforcement directorate (ED) arrested Delhi CM Arvind Kejriwal after he skipped nine summons issued by the ED and the court, in relation to Delhi Excise policy case 2022. He was arrested on Thursday (21st March 2024) after the ED arrested BRS (Bharat Rasta Samithi) leader Kavitha of Telangana state.
He was arrested on Thursday and produced at Rouse Avenue court on Friday where the court rejected his petition for bail in the case. Arvind Kejriwal will be in remand until 28th March 2024 previously on Thursday, he said that his life is dedicated to the country whether he is outside or inside jail.
While the lawyer Abhishek Manu Singhvi, of CM argued that there are no proper evidence of scam for the arrest and asked court how they can arrest without proper evidence related to scam. After the arrest of Arvind Kejriwal the AAM leaders called for protests and many politicians across the country provided their views on the arrest.
Arvind Kejriwal On Arrest
Delhi CM said he is not stepping down as Chief Minister and will be leading the state from the custody itself. Delhi minister Atishi said that Arvind Kejriwal will not be stepping down as CM and will continue to fulfill his duties from the custody itself.
As per Indian law, Prime ministers and chief ministers are treated as common to the public when it comes to law and are not disqualified from their duties even after arrest until they are convicted. Though it is possible to conduct CM duties from custody there are challenges associated in implementing all the duties.
However, as per internal sources, Atishi and health minister Saurabh Bharadwaj are the leading contenders for the next CM position if Arvind Kejriwal gets down. Along with them, the party is likely to give a Revenue services officer to Arvind Kejriwal’s wife Sunitha alongside providing active participation in party matters.
Can Arrest Lead To Prohibition Of Duties?
ED or other department officials can arrest the higher officials like the CM or PM if they think the higher officials may destroy any evidence or don’t follow the legal process. Along with this, the higher officials can be prohibited from their offices only if they are proven convicted.
As per Indian law, only governors and presidents are allowed to have protection from arrest in terms of during their office period. Previously Bihar CM Lalu Prasad Yadav was arrested in a misuse of public funds. The scam came to light in 1990 but he was arrested in 2013 which resulted in 5 five-year jail sentence along with disqualification from the CM position. However, after the arrest of Arvind Kejriwal, AAP has 5 challenges ahead of the party.
Challenges For Aam Aadmi Party
- The Lok Sabha elections are around and Arvind Kejriwal’s arrest put the party in dilemma and have a few challenges ahead. First, the AAP will be contesting in alliance with the Congress in Delhi, Haryana, Gujarat, Chandigarh, and Goa. AAP leader Sandeep Pathak said running the government from jail can be done but as per Sunil Gupta a former law officer, there are challenges like meetings and visits that should be held with CM where it will become difficult for him to do so.
- Second, is choosing the next CM of the state as a rise in Demand for Arvind Kejriwal’s resignation.
- Third is the AAP leadership where under the leadership of Arvind Kejriwal the party received national status. The question here is who is capable of leading next.
- Fourth is winning the upcoming elections in the states and how arrest is going to impact the upcoming elections. The party should make sure to at least win in 1 state of Delhi since Arvind Kejriwal has implemented several schemes that benefited the people of the state.
