UNIFORM CIVIL CODE was one of the BJP’s Manifestos in Uttarakhand. The same is being implemented now after the recent approval of the UCC bill in the state cabinet. To initiate this the state government has formed a committee of 5 members headed by Ranjana Desai (retired supreme court judge). What Is UCC?:

The UCC provides equal civil laws for all communities in the state without considering caste and religion. Citizens will benefit by equal laws in majority categories such as marriages, land property and rights. The objective of the UCC is to have secular law overcoming the religious laws in the society.

Uniform Civil Code in Uttarakhand In Uttarakhand:

Uttarakhand became the first state to implement the UCC while Goa has been following the same since Portuguese time.

The UCC is also part of the constitution that is termed as “UCC directive principles of state policy which cannot be changed by any means in a court of law and fundamental to country’s governance”.

UCC Committee:

The Supreme Court also supports this UCC law, to be implemented in the states of the country while giving judgment in certain cases. The committee gave a 4-volume draft with 749 pages and collected 2.33 lakh written pieces of feedback through 700 forums online & offline.

The committee has engaged with around 60,000 people to draft within 2 years of the period which started on May 27th 2022.

The implementation of UCC will fulfil the majority of manifestos stated during elections and this is the reason why the state government was very keen towards The Uniform Civil Code. This will strengthen the community laws in society with strict action taken upon breaking the law.

UCC Laws:

The bill was smoothly passed in the legislative assembly of Uttarakhand as the BJP has a greater number of seats and came into existence after the governor’s rule in the state. Although the prime points are revealed we have a few points that will be changed once UCC come into existence.

Marriages, maintenance, adoption, succession, divorce and rights will be changed on strict terms. Few religious practices are considered offensive in the Uniform Civil Code. The opposition leaders in the assembly stated they are not against the UCC but against a few provisions in it which will be implemented. However, the CM of Uttarakhand stated it was a historic moment as the bill passed and came into existence.

Conclusion:

Even a live-in relationship requires permission under the UCC Act. The government will have the right to change any act if UCC is considered in implementation, until and unless it doesn’t harm the citizens.

The provisions of civil law will be made effective with official registrations and acts. Few other states are also in favour of implementing the Uniform Civil Code which might come into implementation in coming years.

FACT: The Indian government passed a new anti-cheating law in parliament that will fine Rs1 crore or 10 years in jail if found doing malpractice of any kind.
